Terms and Conditions

1. About the Platform

Omega Mart is an online marketplace that connects independent, third-party vendors ("Vendors," "Sellers," who are also referred to on the Platform as "stalls") with buyers ("you," "Buyer," "Customer"). Omega Mart itself does not manufacture or, in most cases, directly sell the products listed on the Platform, it provides the technology, storefront, payment facilitation, and order infrastructure that allow Vendors to list and sell products to Buyers.

Because of this marketplace model:

• Each product listing is created and managed by the Vendor who owns it.
• Product descriptions, images, pricing, and stock availability are the responsibility of the Vendor.
• Orders may contain items from one or more Vendors, and may be shipped separately as a result.

2. Eligibility and Account Registration

• There is no minimum age restriction to browse the Platform. However, by placing an order or entering into a purchase, you confirm that you are legally capable of entering into a binding contract under the laws of Bangladesh, or that the order is placed with the involvement or consent of a parent or guardian where required by law.
• You agree to provide accurate, current, and complete information when creating an account or placing an order (name, delivery address, phone number, and email).
• You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account.
• Omega Mart reserves the right to suspend or terminate any account that provides false information, is used fraudulently, or is used to abuse other users, Vendors, or the Platform.

3. Orders and Contract of Sale

• Placing an order on the Platform is an offer by you to purchase the listed product(s), which is accepted when the Vendor confirms and processes the order.
• The contract of sale for each product is formed directly between you and the relevant Vendor. Omega Mart facilitates the transaction (listing, payment processing, order coordination, and dispute support) but is not itself the seller of record unless a listing explicitly states that Omega Mart is the seller.
• Omega Mart reserves the right to cancel any order, in whole or in part, in cases of: pricing or listing errors, suspected fraud, stock unavailability confirmed after order placement, or delivery-area restrictions. Where an order is cancelled by Omega Mart or a Vendor after payment, a full refund will be issued.

4. Pricing and Payment

• All prices listed on the Platform are in Bangladeshi Taka (BDT) and are set by the individual Vendor, unless otherwise stated.
• Prices may include or exclude delivery charges, which will be clearly shown at checkout before you confirm your order.
• Omega Mart supports Cash on Delivery and online payment methods as made available on the Platform from time to time, including bKash, Nagad, Rocket, and other mobile financial services, cards, or bank transfer. Available options may vary depending on the Vendor, product category, or delivery location.
• Vendors may adjust prices or run promotions at their discretion; price changes do not affect orders already confirmed.

5. Delivery

• As Omega Mart is a marketplace for handmade and small-batch goods, delivery timelines vary by Vendor and product. As a general range, orders are typically shipped and delivered within 2 to 7 days of ordering, depending on whether the item is ready-made or produced to order ("made-to-order"). The specific expected timeline for a product is shown on its listing page, please review it before ordering, as it is part of the purchase.
• Vendors are required to ship each confirmed order within this 2 to 7 day window; Vendors who fail to do so are subject to Omega Mart's Vendor performance enforcement process (see our Vendor Terms and Conditions).
• You are responsible for providing an accurate and reachable delivery address and phone number. Omega Mart and its Vendors are not liable for delivery failures caused by incorrect or incomplete address information provided by the Buyer.
• Risk in the product passes to you upon delivery, subject to your inspection and return rights described in our Return, Refund and Exchange Policy.

6. Product Inspection at Delivery

Omega Mart operates an "open-box" / check-before-you-accept model on eligible items: you may inspect the product in front of the delivery rider at the time of delivery and decline to accept it on the spot if it is damaged, defective, incorrect, or materially not as described. Details, exceptions, and the post-delivery return window are set out in our Return, Refund and Exchange Policy, which forms part of these Terms.

7. Cancellations

• You may cancel an order before it has been dispatched by the Vendor, subject to the cancellation option being available on the Platform for that order status.
• Once an order has been dispatched, it can no longer be cancelled and instead falls under our Return, Refund and Exchange Policy.
• Omega Mart or the Vendor may cancel an order due to stock unavailability, pricing errors, delivery-area limitations, or suspected fraudulent activity, with a full refund issued for any amount already paid.

8. Role of Omega Mart as an Intermediary

• Omega Mart is a marketplace/intermediary platform. While we take reasonable steps to vet Vendors and moderate listings, we do not manufacture, physically inspect (in the ordinary course), or take title to most products sold on the Platform.
• Product quality, accuracy of description, authenticity, and legal compliance of listed items are the responsibility of the Vendor. Omega Mart will assist in resolving disputes between Buyers and Vendors (see our Buyer's Protection Policy) but does not guarantee the conduct of independent Vendors.
• Omega Mart reserves the right to remove any listing, suspend any Vendor, or refuse to process any order that it reasonably believes violates these Terms, applicable law, or Platform policies.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law in Bangladesh, including the Digital Commerce Operation Guideline, 2021 and the Consumer Rights Protection Act, 2009.
• Submit false, misleading, or fraudulent orders, reviews, or claims (including false claims of non-delivery or damage to obtain unwarranted refunds).
• Attempt to interfere with, hack, reverse-engineer, or disrupt the Platform's systems or security.
• Harass, abuse, or threaten Vendors, delivery personnel, or Omega Mart staff.

Violation of this section may result in order cancellation, account suspension, or permanent termination of access to the Platform, at Omega Mart's discretion.

10. Intellectual Property

• The Omega Mart name, logo, website design, and platform software are the property of Omega Mart and may not be copied, reproduced, or used without written permission.
• Product images, descriptions, and brand content uploaded by Vendors remain the intellectual property of the respective Vendor or brand owner. Vendors are solely responsible for ensuring they have the right to use any content they upload.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Omega Mart's liability for any claim arising from your use of the Platform is limited to the value of the specific order giving rise to the claim.
• Omega Mart is not liable for indirect, incidental, or consequential losses, including loss of data, loss of business, or loss of opportunity.
• Nothing in these Terms limits any liability that cannot be limited under the laws of Bangladesh, including in respect of fraud or willful misconduct.

12. Dispute Resolution and Governing Law

• These Terms are governed by the laws of the People's Republic of Bangladesh.
• Any dispute arising out of or relating to your use of the Platform shall first be attempted to be resolved through Omega Mart's customer support (support@omegamartbd.com). If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

13. Changes to These Terms

Omega Mart may update these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
